Background: In Switzerland, non-medical right-to-die organisations such as Exit Deutsche Schweiz and Dignitas offer suicide assistance to members suffering from incurable diseases. Objectives: First, to determine whether differences exist between the members who received assistance in suicide from Exit Deutsche Schweiz and Dignitas. Second, to investigate whether the practices of Exit Deutsche Schweiz have changed since the 1990s. Methods: This study analysed all cases of assisted suicide facilitated by Exit Deutsche Schweiz (E) and Dignitas (D) between 2001 and 2004 and (...) investigated by the University of Zurich’s Institute of Legal Medicine (E: n = 147; D: n = 274, total: 421). Furthermore, data from the Exit Deutsche Schweiz study which investigated all cases of assisted suicide during the period 1990–2000 (n = 149) were compared with the data of the present study. Results: More women than men were assisted in both organisations (D: 64%; E: 65%). Dignitas provided more assistance to non-residents (D: 91%; E: 3%; p = 0.000), younger persons (mean age in years (SD): D: 64.5 (14.1); E: 76.6 (13.3); p = 0.001), and people suffering from fatal diseases such as multiple sclerosis and amyotrophic lateral sclerosis (D: 79%; E: 67%; p = 0.013). Lethal medications were more often taken orally in cases assisted by Dignitas (D: 91%; E: 76%; p = 0.000). The number of women and the proportion of older people suffering from non-fatal diseases among suicides assisted by Exit Deutsche Schweiz has increased since the 1990s (women: 52% to 65%, p = 0.031; mean age in years (SD): 69.3 (17.0) to 76.9 (13.3), p = 0.000), non-fatal diseases: 22% to 34%, p = 0.026). Conclusions: Weariness of life rather than a fatal or hopeless medical condition may be a more common reason for older members of Exit Deutsche Schweiz to commit suicide. The strong over-representation of women in both Exit Deutsche Schweiz and Dignitas suicides is an important phenomenon so far largely overlooked and in need of further study. (shrink)

The experience of having to suffer debilitating pain is far too common in the United States, and many patients continue to be inadequately treated by their doctors. Although many physicians freely admit that their pain management practices may have been somewhat lacking, many more express concern that the prescribing of heightened levels of opioid analgesics may result in closer regulatory scrutiny, criminal investigation, or even criminal prosecution.Although several researchers have examined the regulatory environment and the threat of sanction or harm (...) it poses to physicians and patients, few have examined the likelihood of investigation or prosecution stemming from the aggressive use of opioids in physician-directed pain management. Accordingly, in an effort to assess whether the fear of prosecution is realistic and, if so, what factors contribute to its likelihood, we surveyed chief prosecutors in four states about their knowledge, opinions, and attitudes concerning opioids and the prosecution of physicians stemming from the treatment of patients who were either terminally ill or suffering from chronic noncancer pain. The legalization of physician-assisted suicide remains a hotly debated issue throughout the United States, and continues to capture the attention of government officials at both the state and federal levels. While the practice is currently legal in Oregon, some federal lawmakers and officials from the U.S. Department of Justice have attempted to outlaw that state's practice through legislation, or through a strained interpretation of the federal Controlled Substances Act. And while several citizen groups throughout the United States have attempted but (...) failed to legalize PAS through popular initiative, several state lawmakers have succeeded in specifically outlawing the practice. Yet even though physician-assisted suicide remains unlawful in every state except Oregon, there is ample evidence that American physicians throughout the United States have participated in PAS by providing their terminally ill patients with lethal prescriptions. The financial crisis of 2008 raised the politics of regulation to a new level of practical and scholarly attention. We find that recent reforms in U.S. financial markets hinge on intellectual resources and new organizational actors that are missing from existing concepts of regulatory capture or business power. In particular, small advocacy groups have proven significantly more successful in opposing the financial services industry than existing theories predict. By maintaining the salience of reform goals, elaborating new analytic frameworks, and deploying (...) specialized expertise in post-enactment debates, smaller organizations have contributed to a diffuse but often decisive network of pro-reform actors. Through the rule-writing process for macroprudential supervision and derivatives trading, these small organizations coalesced with other groups to form a new stability alliance that has so far prevented industry groups from dominating financial regulation to the degree that occurred in earlier cases of regulatory reform. To what extent are people able to make predictions about other people’s preferences and values? We report two experiments that present a novel method assessing some of the basic processes in surrogate decision-making, namely surrogate-utility estimation. In each experiment participants formed dyads who were asked to assign utilities to health related items and commodity items, and to predict their partner’s utility judgments for the same items. In experiment one we showed that older adults in long-term relationships were able to accurately (...) predict their partner’s wishes. In experiment two we showed that younger adults who were relatively unfamiliar with one another were also able to predict other people’s wishes. Crucially we demonstrated that these judgments were accurate even after partialling out each participant’s own preferences indicating that in order to make surrogate utility estimations people engage in perspective-taking rather than simple anchoring and adjustment, suggesting that utility estimation is not the cause of inaccuracy in surrogate decision-making. The data and implications are discussed with respect to theories of surrogate decision-making. (shrink)

Christian ethicist Nancy Duff has suggested that an apocalyptic hearing of the gospel elicits a parabolic understanding of the Christian moral life. How might the theological basis and rationale of this claim be elaborated? What is it about human life funded by the gospel of God’s apocalypse in Jesus Christ that makes ‘parable’ an apt description of the quality of its action? And how might these notions be elaborated to enrich our understanding of responsible moral action more generally? This article (...) explores these questions by way of a running conversation with the work of J. Louis Martyn, Christopher Morse and Paul Ricoeur. It concludes by showing the salience of these themes in relation to Bonhoeffer’s later reflections upon the distinctive quality of Christian life in the wreckage of Christendom. Overall, the solid currency of a parabolic construal of the character of Christian moral action for the present pursuit of theological ethics is recommended. (shrink)

This paper argues that Calvin provides an account of the radical unmaking of the human moral subject at the hands of sin and its even more radical remaking at the hands of divine grace. The moral significance of human continuity during this soteriological transit, including such things as reason and will as such, is shown to be overreached by that of what becomes of the human creature in its history at the hands of both sin and God’s grace. Calvin’s treatment (...) of the first and third uses of the law confirms and illumines this claim decisively. Insight into this matter is aided by consideration of J. Louis Martyn’s discussion of the status of the moral subject in Pauline paraenesis A Reformed theological ethic that takes its cues from Calvin’s teaching in this regard will thus regard the adventitious realities of sin and grace, and their serial consequences for the constitution of the human moral agent, to represent the most important meta-ethical realities to be considered. Any theory of information needs to comply with what we call the implementation, formalization, and representation constraints. These constraints are justified by basic considerations concerning scientific modelling and methodology. In the first part of this paper, we argue that the implementation and formalization constraints cannot be satisfied because the relation between Shannon information and IIT must be clarified. In the second part of the paper, we focus on the representation constraint. We argue that IIT cannot succeed in satisfying this constraint (...) for semantic contents without offering models for concepts, conceptual roles, and context sensitivity. In the final part of the paper, further complications are raised with respect to the distinction between consciousness and attention, which apply more specifically to the representation constraint. We conclude with some recommendations as to how IIT may succeed in solving these problems, highlighting the advantages and enormous potential of IIT as a scientific theory. (shrink)

Basado enteramente en pruebas internas, este estudio se propone mostrar que el manuscrito único del Dīwān de Ibn Quzmān, publicado en edición facsímil por David de Gunzburg en 1896, es una copia dictada. Se indica también que el copista, a quien con frecuencia se ha culpado de introducir en el texto popular andaluz correcciones o clasicismos, no estaba bien equipado para desempeñar tal papel. Si bien era un calígrafo de primera categoría, se aducen pruebas de que su conocimiento del árabe (...) no estaba a la altura de la calidad de su caligrafía. El estudio muestra que él fue el responsable de una amplia gama de problemas textuales que ha dejado perplejos a sucesivos editores del Dīwān. En marcado contraste, se muestra que Ibn Quzmān poseía un dominio magistral de la lengua árabe y de las tradiciones-árabes clásicas. Al parecer también había adquirido un alto grado de 'aculturación' en la lengua romance. Además de ofrecer las pruebas en que se basan estos asertos, el estudio constituye un ejemplo ilustrativo de cómo estas pruebas pueden ayudar a una mejor lectura e interpretación del Dīwān de Ibn Quzmān. This chapter attempts to improve our conception of objectivity in general, especially in journalism and other media work. It defends the twin theses that: Global news media needs a new conception of objectivity and the conception of pragmatic objectivity is a viable candidate, and pragmatic objectivity is part of a radical rethinking of journalism and media ethics. It is an alternative to the professional objective model, a still-influential traditional idea of the objective journalist as a neutral stenographer of fact. Journalists (...) need to disrupt this model of good journalism. The chapter reconstructs objectivity as a natural evaluative capacity of humans that is situated and holistic. Then, it uses this naturalistic perspective to articulate pragmatic objectivity and apply it to journalism. (shrink)

This article discusses a number of metaphors about the nature of science, in connection with three types of metaphysical realism: minimal, moderate and essentialistic realism. From the beginning, Kuipers accepts the first and rejects the third type of realism, but it is only later on that he endorses the second type. It is argued that this makes his remarks on essentialistic realism somewhat misleading; and his moderate realism is compared with some realist positions taken by other philosophers. It is further (...) argued that the metaphors of the mirror, the net and the map correspond to essentialistic, minimal and moderate realism, respectively. This explains why the map metaphor is by far the most suitable one in the context of Kuipers' theory of science. This does not imply, however, that it is the (only) true one and that the others are false. (shrink)
